By accessing or using the Base44 platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization (e.g., an HVAC company), you represent that you have the authority to bind that organization to these terms.
2. Description of Service
Base44 is a field service, asset management, and data-tracking software designed to assist users in logging equipment specifications and tracking refrigerant usage.
3. Regulatory Compliance & Limitation of Liability
Base44 is a software tool, not a regulatory body, legal advisor, or compliance guarantor.
- User Responsibility: You and your organization are solely responsible for ensuring that all data entered, calculated, and exported through Base44 complies with local, state, and federal laws, including but not limited to the EPA Section 608 rule, the AIM Act, and CARB regulations.
- No Guarantee: Base44 makes no warranties regarding the accuracy of leak rate calculations, threshold alerts, or compliance statuses if the underlying data entered by the user is flawed, incomplete, or categorized incorrectly. Base44 is not liable for any regulatory fines, audits, or legal actions brought against your organization by the EPA or any other governing body.
4. Artificial Intelligence (AI) and Optical Character Recognition (OCR)
The Service utilizes third-party Artificial Intelligence (AI) to extract data from uploaded images (e.g., equipment data plates).
- AI Limitations: AI models can hallucinate, misread degraded text, or generate inaccurate data.
- Mandatory Verification: Users are strictly required to manually verify all data extracted by the OCR feature before saving it to the database. Base44 is not liable for any corrupted records, compliance failures, or operational errors resulting from unverified AI-generated data.
5. Fair Use, Storage, and Quotas
To ensure platform stability, Base44 enforces "Fair Use" policies.
- API & Processing Limits: Base44 reserves the right to throttle, suspend, or charge overage fees for accounts that exceed standard commercial usage of the AI OCR processing tools.
- Data Storage: While we implement robust cloud storage, Base44 does not guarantee indefinite or infinite storage of high-resolution image files. We reserve the right to compress historical images or enforce storage quotas based on your subscription tier.
6. SMS Communications Program
By opting into our SMS service, you agree to receive automated dispatch, compliance, and account alerts.
- Opt-Out: You can cancel the SMS service at any time by replying "STOP".
- Help: Reply "HELP" for assistance.
- Rates: Message and data rates may apply. Message frequency varies based on your account activity. Carriers are not liable for delayed or undelivered messages.
7. General Limitation of Liability
To the maximum extent permitted by law, Base44 and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, resulting from your use of the Service. In no event shall Base44's aggregate liability exceed the total amount paid by you to Base44 in the twelve (12) months preceding the claim.
